The subject of this monograph is the issue of home searches within the framework of Criminal Procedural Law. The aim of the work is to highlight the home search as a procedural act with a dual function and to provide a fuller understanding of the high degree of intrusiveness of this procedural measure on the individual right to asylum.
Specifically, the work begins with the recording of the multi-layered protection reserved for the asylum of the residence in domestic and international legal order. In the second part, the investigative act of the home search, as provided for in the Greek Code of Criminal Procedure, is presented through the recording of its basic morphological characteristics and the conditions for its lawful conduct.
Subsequently, the limits of the authority of those carrying out the home search are examined, which are also influenced by additional parameters. Next, the set of procedural rights of the person affected by the home search is explored, as well as the means of judicial protection against illegal state interventions in domestic asylum.
The last chapter of the monograph is dedicated to the conduct of the home search within the framework of international judicial cooperation in the field of criminal evidence. This monograph offers a comprehensive and well-founded analysis of the legal framework of the home search at both theoretical and practical levels, highlighting its significance in the evolving European legal environment, promoting solutions for the legal practice thereof.
