This study examines the concept, forms, and consequences of permissible deviations during the transition from the system of transcripts and mortgages to the system of the functioning cadastre. It starts with a presentation of the different measurement methods over the years and in various regions of Greece, and the utilization of previous titles of ownership for the identification, delimitation, and recording of properties in the new topographic diagrams currently prepared by land surveyors, as well as the adaptation and harmonization of the data arising from these (old titles of ownership) to the modern measurement systems of the national cadastre.
The central focus of the study is the analysis of the causes of deviations, such as errors in data entry, inaccurate or incomplete documents, inconsistencies between tax and cadastral information, the forms they may take, and the geometric uncertainties that arise as a consequence, as well as the absence of formalization and implementation of a unified legislation in the country regarding the issue both at the stage of cadastre recordation and in the regime of a functioning cadastre. Additionally, the concept of deviation is analyzed concerning laws outside the cadastre, such as urban planning, forestry, and tax laws, while always centering on the property.
Finally, the study analyzes the processes for correcting and updating the data recorded in the functioning cadastre database when deviations exceed acceptable limits or vice versa. Overall, the aim of this contribution is to provide a comprehensive view of the management of deviations and the practical issues arising during the application of the National Cadastre in Greece today, in the absence of a unified legislative regulation on the matter and the ensuing caution and hesitation surrounding this specific direction.
