Description

The Directive (EU) 2021/2118 on the insurance of civil liability arising from the use of motor vehicles is an amendment to the codified Directive (EU) 2009/103/EC, which has already incorporated the first five Directives according to which Law 489/1976 (cod. p.d. 237/1986) was harmonized and has functioned fully to this day.

The Directive (EU) 2021/2118 was harmonized with Greek law through the issuance of Law 5113/2024 with the aim of ensuring effective protection for victims of road traffic accidents (Article 1) in the event of insolvency of an insurance company, whether the accidents occur in the member state of the victims' habitual residence (Article 19a) or in a member state other than their habitual residence (Article 19b).

These issues were deemed appropriate to be included in a new edition of the basic legislation of insurance law (6th edition) for the complete information of all interested parties.

Also, at the end of the entire legislation, Law 5116/2024 concerning private insurance against natural disasters was added, as amended by the recent Law (Law 5162/2024, Official Gazette A' 198/5.12.2024) “Measures to Strengthen Income, Tax Incentives for Innovation and Business Transformations, and Other Provisions,” which includes provisions for mandatory insurance of businesses and vehicles against natural disasters (Article 5 and 5A) as well as for the establishment of an Observatory for Private Insurance against Natural Disasters (Article 3).
