Continuing our effort to present as comprehensively and up-to-date as possible the legislation governing competition (unfair and free), as well as consumer protection law, we aim, with this edition, to respond to this goal.

This is a difficult undertaking, as the legislation in this area of law – primarily in the field of consumer protection – is in a process of continuous amendment and supplementation, while there are also significant union-character legislative acts, such as Directive 2014/104/EU, concerning national law claims for compensation for violations of competition law, which is expected to be transposed into our law in the very near future.

However, since this is an important legislative text that broadens and adjusts the issue of judicial protection in cases of violations of competition provisions, we deemed it necessary to include its provisions in the relevant subject matter, that of free competition law.

At the same time, given the difficult economic circumstances and the efforts to resolve the problems that plague the socioeconomic reality, consumer protection law is found in various legislative documents that do not directly belong to this subject, yet influence and directly define it, such as the Code of Ethics for Banks of Law 4224/2013, the many and successive regulations concerning so-called "red loans," regulations for the extrajudicial resolution of consumer disputes at the national and intra-Union level, and Ministerial Decision 70330/2015, which transposed into Greek law the provisions of Directive 2013/11/EU and took supplementary measures for the application of Regulation 524/2013 on the electronic resolution of consumer disputes.

Very recently, presidential decree 10/2017, referred to as the Consumer Ethics Code, was issued, which we also include in this edition. In view of this situation and given the overall legislative and socioeconomic fluidity, we express the reservation that we may soon find ourselves facing a new amendment to the relevant legislation.

For this reason, we seek the reader's understanding and renew our promise for the prompt and timely updating of the provisions of competition law and consumer protection. In this context and due to the issuance of the so-called "multi-law" 4512/2018, which, among other things, attempted significant amendments to the provisions of Law 2251/1994 through articles 100-111, we proceed to the immediate inclusion in this work of the Decision of the Minister of Economy and Development, no. 5338/17.1.2018, which made a first administrative codification of Law 2251/1994, in accordance with the legislative mandate of § 2 of Article 110 of Law 4512/2018.

At the same time, and to avoid confusion, we remove from the body of Law 2251/1994 and present it after its final provisions, the inter-ministerial decision 70330/30.6.2015, which governs the extrajudicial resolution of consumer disputes and which we had included in the body of Law 2251/1994, to which it belongs, as it essentially constitutes a continuation of Article 11; however, it escaped the legislator’s attention and consequently that of the competent Minister and remained outside Law 2251/1994.
