This monograph analyzes the issue of the scope of illegality under Article 914 of the Greek Civil Code (particularly through the recognition of obligations of care). The interpretation of the concept of illegality, as a condition for tort liability, is one of the most critical problems in the law of non-contractual liability.
This work constitutes a thorough study of the issue under Greek law, alongside a comparative legal analysis of Anglo-Saxon and German law, as well as a historical overview of the origins of the institution. Particularly, the fourth chapter is dedicated to Greek law.
As noted, the Greek legislator chose to include, in Article 914 of the Civil Code, a general clause, thus providing greater protection to the injured party. The study in this chapter, as well as the entire work, is comprehensive and in-depth, while also characterized by a critical approach, offering useful observations for the reader.
The study examines the crucial issue of expanding illegality, with developments based on extensive and highly informative case law, which is critically analyzed. The relevant case law is categorized into various types to facilitate understanding and clarity for the reader.
With the content above, this work thoroughly explores the issue of obligations of care. The author addresses many highly debated aspects of it and takes into account, with a critical approach, the rich Greek and even richer English and German related literature, emphasizing the work’s significant contribution to solving practical issues through convincing and fully substantiated positions.
