The granting of public lands for the restoration of landless farmers, combined with the compulsory expropriation of lands for the settlement of these landless farmers, whether indigenous or refugees, takes place within a complex legal mechanism.
This mechanism is characterized by the presence of so-called anomalous legal transactions, which are a striking example of lenient law, through the possibility of their validation.
This work analyzes the real estate relations in Settler Law, the constitutional dimension of settlement legislation, the acquisition of ownership by the lottery winners (distribution, allotment, disposition of lots, principle of non-fragmentation - exceptions, creation of non-regular plots), the servitudes and mortgage in Settlement Law, the establishment on the lot, the anomalous legal transactions and their validation, various specific issues (adverse possession, protection of lottery winners, inheritance issues, abusive exercise of rights).
At the same time, the rich case law of Greek courts has been taken into account, which has played a role in shaping settlement relations in a way that favors the fulfillment of the objectives of settlement legislation.
