The "compulsory provision of passage according to the Civil Code 1012-1017 often occupies practice, as evidenced by the rich related case law. However, apart from its practical interest, it also presents theoretical interest.

Moreover, in law, the interdependence and interaction of theory and practice is inevitable and inherently part of the nature of the matter. This work includes an Introduction (I), Systematic Interpretation (II), Article-by-Article Interpretation (III), and Models (IV). All opinions are presented, along with, as far as possible, complete case law and bibliography.

At the same time, a new perspective is attempted regarding the distinction between direct and indirect restrictions in the case of Civil Code 1012 et seq., and a combination of the two basic theories is proposed, so that the restriction as indeterminate becomes active when specified, either contractually or by judicial decision, with respect to the elements of the passage and the corresponding compensation – without the need for the establishment of a servitude.
