The impact of legal proliferation, legal deficiencies, and poor enforcement of laws has been visible and burdensome for the everyday life of the Greek citizen for many years.
For legal practitioners, the existence of conflicting and contradictory laws characterizes significant sectors of public administration and creates serious problems during their application. Among other things, tax, urban planning, and social security legislation constitute areas of legislative activity where identifying the applicable provisions poses a challenging legal challenge.
As a cause of endemic legal proliferation, beyond the expanded role of the state and the new responsibilities it has undertaken, is the intense pressure from various interests by pressure groups and individuals seeking exceptions from general rules and the implementation of preferential arrangements. In response to this demand, the clientelist Greek state often acts in violation of the principles of equality and the rule of law.
The aim of the reflections that follow and are developed in the book is to describe and highlight the main factors that reinforce the aforementioned pathological phenomena. Essentially, a mapping of legal deficiencies is proposed. Along this journey, it was considered that the contribution of comparative examples from the European Union and other legal systems would decisively aid in clarifying these phenomena. The study concludes with the drawing of conclusions and the proposal of solutions at the level of constitutional policy as well as legislative reforms.
