This book fills a gap in the Greek literature as it presents a comprehensive and thorough approach to the current Greek law on civil medical liability, tortious acts, and contractual liability.

The obligation of the person providing medical services to compensate for "errors" or other violations of their obligations is an issue of increasing importance in the practice of both civil and administrative courts, which presents unique interest as well as specific difficulties.

Modern findings from Greek and foreign case law and theory are synthesized and utilized in the book to assist legal practitioners in addressing the most critical issues of medical liability.

In the first part of the book, a comprehensive review of the phenomenon of civil medical liability is attempted. After a general introduction, the relationship between medical liability and insurance (social insurance, civil liability insurance, insurance of patients for medically induced injuries) is analyzed more specifically, along with the legal nature of liability (subjective/objective liability, liability from risk), as well as its relationship with the liability of service providers, according to Article 8 of Law 2251/1994.

The second part provides a detailed analysis of: a) The concept of medical acts, with emphasis on the issue of legal consequences of medical acts conducted without the valid consent or adequate information of the patient (extent of damage recoverable, burden of proof, counterclaims by the doctor), as well as in certain specific cases of medical acts (aesthetic interventions, assisted reproduction). b) The contract between the patient and the doctor (content, formation, contracting parties, legal nature). c) Medical error, as the main lawful reason for liability (definition, evaluation criteria, distinctions, burden of proof, special issues such as diagnostic errors, medical omissions, and refusal or interruption of medical services, correction of medical errors, etc.).
