The structural elements of the crime, theories of causality, and the problematic nature of the normative autonomy of objective imputation of the crime are analyzed. The author favors the institutional-functional/systemic theory of "culpability" as a more suitable theory of objective imputation. Special emphasis is given to the (legal) philosophical foundation of this norm through the comparative examination of broader formations of contemporary philosophical discourse.
