The work of Mr. Charalambos Sevastidis, Judge, is addressed to the legal theory and practice and attempts to provide answers and solutions to serious issues that are likely to arise in criminal proceedings after the significant amendments of the Criminal Procedure Code (CPC) by Law 3160/2003, as well as the subsequent corrective intervention of Law 3189/2003. At the same time, an effort is made towards a new different approach to a series of provisions of the CPC, which are directly or indirectly affected by the aforementioned amendments.
In this work, all the opinions that have been supported over time regarding the amended provisions of the CPC are presented, while the entire relevant (rich) case law is also utilized. For a better understanding of the new provisions and their connection to the previous law, reference is made to the draft laws that preceded the enactment of Law 3160/2003, while a special chapter is dedicated to the issues of perennial law that are likely to arise.
For a better understanding of the interpreted provisions of the CPC, as amended by Laws 3160/2003 and 3189/2003, the article-by-article analysis of Law 3160/2003 was preferred. Finally, this work is accompanied by detailed indexes (lexical and article-by-article) that make it particularly user-friendly.
