Description

The Regulation (EC) 1393/2007 of the European Parliament and of the Council concerning the service and communication of judicial and extrajudicial documents in civil and commercial matters is the most important and frequently applied legislative text in the field of European procedural law.

Its application essentially extends to every private law dispute of a cross-border nature within the EU. This fact has created an extremely rich case law both at the level of the Court of Justice of the European Union (CJEU) and at the level of national courts, and the systematic approach to this is presented as urgent and necessary.

This is precisely the purpose of the article-by-article presentation of Regulation 1393/2007. The interpretation is primarily practically oriented. The approach to the case law is made thoroughly in the work so as to demonstrate its compatibility with the choices of the European legislator, as our courts were for a long time accustomed, before the introduction of the Regulation, to solutions that were not always equivalent to those of the then exclusively applicable and still enforced Hague Convention of 1965 on service abroad (Law 1334/1983).

The work is the second, to date, article-by-article interpretation of the most important European Regulations of private/international law, following the previous Regulation (EC) 2201/2003 of the Council on international jurisdiction and the enforcement of judgments in matrimonial disputes and disputes concerning parental responsibilities, published by professors P. Arvanitakis and E. Vasilakakis from Aristotle University of Thessaloniki, in collaboration with leading academics, judges, and lawyers in our country.

It is a work that guarantees a valid, concise, yet detailed interpretative approach to the Regulation on service and the case law that has been shaped in view of it, for every judge or lawyer who is called to address practical application issues.
